Short answer: yes, foreigners can legally own property in Phuket — but the way you own it depends on what you buy. Thai law treats condominiums very differently from land and houses, and understanding that distinction is the single most important thing before you start viewing properties for sale.
Condominiums — freehold, in your own name
The cleanest route to foreign ownership is a condominium. Under the Condominium Act, foreigners can own units outright (freehold) provided that no more than 49% of the total floor area of the building is foreign-owned. The remaining 51% must stay in Thai hands. For most well-managed condo developments this quota is available, and the unit goes into your name at the Land Office.
You will need to show that the purchase funds were transferred into Thailand from abroad in foreign currency, evidenced by a Foreign Exchange Transaction form from the receiving bank. Keep that paperwork — you need it again when you eventually sell.
Villas, houses and land
Foreigners cannot own land in their own name. That does not mean villas are off-limits — it means the structure and the land are handled separately:
- Leasehold: a registered 30-year lease over the land, commonly with renewal options, while you own the building on it. This is the most common structure for foreign villa buyers and is straightforward to register.
- Thai company: a properly run Thai limited company can own land. This is legitimate when the company is a genuine operating entity, but it carries accounting and compliance obligations and should never be a "nominee" shell.
Because the right structure depends on your goals, doing your market research up front — and taking independent legal advice — saves expensive mistakes later.
